TERMS AND CONDITIONS

 

PLEASE NOTE: All bidders agree that they have read and fully understand these terms and conditions and agree to be bound thereby.

Closing Procedure: The highest final bid received (assuming the minimum price is met) at the closing of the bidding on eBay will be considered the final bid accepted by Mypersonalauctioneer.com (the Auctioneer). The Auctioneer will proceed to close the sale with the final bidder. The highest bidder will be required to send the Auctioneer certified funds (cashier's check or money order) within 7 days of the close of the auction. The Auctioneer will then ship the item within 5 days after receiving certified funds from the highest bidder. If the item is a document, the Auctioneer may have 14 days to obtain relevant signatures before sending the document. All items require PAYMENT-IN-FULL before the item will be shipped to buyer.

If the highest bidder for some reason does not close the sale within 14 days from the close of auction, the Auctioneer reserves the right to proceed to the next highest bid received and close with that bidder. The bidder in default may be held responsible for the difference in the bids, or the entire amount of his/her bid should the second highest bidder not take the option to become the successful bidder. The bidder in default is also liable for all legal and collection fees. Buyers must comply with the rules and regulations set forth by eBay. The Auctioneer may take any legal action necessary against default bidders as allowed by eBay rules and regulations.

No Warranties: The property will be sold as is, where is, with no warranties implied or stated, subject to any existing liens and encumbrances known or unknown by the Auctioneer. ALL SALES ARE FINAL.

Condition Of Items Sold: The Auctioneer has made all available known information that has been received relating to the subject properties and that information is available to all potential purchasers to view and/or download. Buyers are encouraged to do their own research prior to bidding. The Auctioneer shall not be responsible for the correct description, authenticity of, or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloguing, or any imperfection not noted. No deduction will be allowed on damaged articles as all goods are sold as is and without recourse.

Sale by Estimated Weight, Count, or Measure: When items are sold in this manner the purchaser will be billed accordingly.  If upon delivery a shortage exists, the purchaser will receive a refund at the rate of purchase.  However, if there is an excess the purchaser will be billed in the same manner and required to take the excess.

Sales Tax: Buyer subject to Arizona State and local sales tax of 8.1% if resident of Arizona

Shipping: Bidders are responsible for the shipping of all items purchased. The Auctioneer will not provide shipping. The Auctioneer cannot provide insurance on items shipped and does not guarantee the shipping for any item, nor the condition of the item upon delivery. If shipping insurance is requested by the buyer, the Auctioneer will add the cost to the final bid as set forth by the chosen shipping company.

Dispute Between Bidders: If any dispute between bidders occurs the auctioneer may decide to put the lot up for sale again.  the auctioneer's decision is final and absolute.

Personal And Property Risk: Buyers assume all risks of damage of or loss to person or property and specifically release the Auctioneer from liability therefore. Neither the Auctioneer nor his principal(s) shall be liable by reason of any defect in, or condition of the premises on which the sale is held.

Addition To Or Withdrawal From Sale: The auctioneer reserves the right to withdraw from the sale any property listed and also to add property not listed to the sale. Also, the auctioneer may group lots or subdivide lots in order to benefit the seller.  The auctioneer reserves the right to sell the property listed in bulk.

Record: The record of sale that is kept by the Auctioneer or his clerk will be taken as final word in the event of a dispute.

Agency: The Auctioneer is only an agent and is not responsible for the actions of his consignor(s).

Announcements/Changes: Any announcements/changes on the day of the auctions shall take precedence over any previously distributed information or advertising.

Auctioneer’s Liability: If for any reason whatsoever the auctioneer fails to deliver an awarded lot, the Auctioneer's sole liability shall be the return of any deposit or moneys paid on such non-delivered lot.

Title: The seller(s) maintain a first security interest in all items until payment is received, including the collection of all funds. The Auctioneer and its personnel assume no responsibility for any missing or damaged items and are not acting as the buyer’s security agent. The Auctioneer will not refund any buyer for missing, stolen or broken items.
